By accessing or using Frequency 24/7 · LIVE ("the Platform"), operated by Bebe Ray Gardon ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all visitors, users, and others who access or use the Platform.
Frequency 24/7 · LIVE is an online platform that allows users to create, broadcast, and listen to live radio stations and podcasts. The Platform also includes a dropshipping marketplace, AI-powered tools, a live recording studio, theme customization, fan gifting, and related services.
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You must be at least 13 years old to use the Platform.
You retain ownership of all content you upload to the Platform. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content in connection with operating the Platform. You represent that you own or have the necessary rights to all content you upload, and that your content does not infringe any third-party rights.
You must not upload content that: (a) infringes any copyright or trademark; (b) is defamatory, obscene, or offensive; (c) violates any applicable law or regulation; (d) contains malware or harmful code.
The Platform offers both free and paid subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. Subscription fees are non-refundable except as described in our Refund Policy. We reserve the right to change subscription prices with 30 days' notice.
The Platform includes a dropshipping store where products are fulfilled by third-party suppliers. We act as an intermediary and are not responsible for the quality, safety, or legality of products sold by third-party suppliers. All purchases are subject to our Refund Policy. Product images and descriptions are provided for informational purposes and may vary from actual products.
The Platform allows users to purchase virtual coins and send gifts to content creators. Virtual coins have no cash value and are non-refundable once purchased, except as required by applicable law. Creator earnings from gifts are subject to our payout schedule and minimum withdrawal thresholds.
You agree not to: (a) use the Platform for any unlawful purpose; (b) harass, abuse, or harm other users; (c) broadcast copyrighted music without proper licensing; (d) attempt to gain unauthorized access to any part of the Platform; (e) use automated tools to scrape or extract data; (f) impersonate any person or entity.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the new Terms.
